Suba, officers appeal decision in Adkins case

Guam - Former police chief Captain Paul Suba and two police officers are appealing the District Court's order denying their motion to dismiss a civil lawsuit filed by local businessman Jim Adkins. Last month some of the claims against Suba and the officers were dismissed, but the court also denied the dismissal of counts that allege violations of free speech, right to privacy and unlawful seizure, false arrest and imprisonment, assault and battery and negligence.
Adkins filed the civil suit after he was arrested for taking photos of a car crash with his cell phone.
Assistant Attorney General Robert Weinberg today filed notices with the court that the officers are appealing the decision to the 9th Circuit Court.
