Will the Guam Legislature intervene with the Simon Sanchez High School procurement protest? According to Education Oversight Chair Senator Vince Borja, the People's House will most likely not get involved, instead they plan to let the protest play its course.

"Entertaining the bill? Yeah we're not. We're trying to stay out of this right now because it is in protest. We don't want to set a precedent for when somebody doesn't agree with a protest, a legislature gets involved because that is not our job," said the senator.

The People's House might not get involved with the procurement protest after all. Committee on Education Oversight Chair, Senator Borja, telling KUAM that there is "no appetite" from the People's House to introduce legislation to meddle with the procurement protest.

Instead the senator proposes a different solution, saying, "Because of just some of the information that has come out of this current procurement is that we would probably would recommend that the Department of Public Works cancel bid and start all over again. Because I know there's some things like the procurement record that the protester is wanting to get copies of which they are not satisfied with so for the sake of Simon Sanchez and the students and the teachers I recommend they cancel the bid and go through it again."

This, despite Lieutenant Governor Josh Tenorio calling upon the Legislature to create a solution to and find a new home for the Sharks.

As KUAM previously reported, the Simon Sanchez project has been in limbo following a procurement protest. To try and expedite the building of Simon Sanchez the lieutenant governor introduced Bill 314-38, "An act to build Simon Sanchez High School now," if passed would allow the Department of Public Works to "proceed immediately with the award, execution, and performance of the contract for the Simon Sanchez High School project."

The proposed legislation also states, "Any protest or appeal related to the procurement of the Simon Sanchez High School project may proceed in accordance with law."

A statement that the Education Oversight Chair does not agree with, with the senator saying, "We're going to be going into muddy waters if we set a precedence by trying to entertain this bill."

Currently the Office of Public Accountability is continuing the hearing on the procurement protest with parties involved having until 5PM May 22 to respond to any filings.
