A man who was caught illegally sneaking onto U.S. soil years after he had been deported will not have to spend any additional time in federal custody.

Forty-three-year-old Clarence Poch was given a year of supervised release during a sentencing hearing held Tuesday before Judge Alex Munson in the District Court of Guam.
Poch had pleaded guilty to attempted re-entry of a removed immigrant.

Assistant U.S. Attorney Marivic David recommended no additional jail time telling the court the defendant already served nine months in prison for his crime, adding he only faced up to six months.

Poch’s deportation will be discussed at a later hearing.

Court records state Poch was deported from the U.S. 10 years ago after being convicted of felony domestic assault in Minnesota back in 2008.
