Defense presses cop involved in Jerry Kitchen crash
A high-profile drunk driving case against defendant Nakita Aguon dragged on in Superior Court before Judge Alberto Tolentino.
Guam Police Officer Joneen Terlaje, who was off-duty the night of the crash, was back on the witness stand today.
Terlaje, who is testifying as the prosecutor’s witness, was a passenger inside the Jeep.
During Wednesday’s cross-examination, the defense showed the jury security camera footage captured from the building where the crash occurred.
Terlaje was also spotted in the video.
Defense attorney, David Lujan highlighted how Terlaje that night approached the security guard and GPD officers at the scene, arguing that Terlaje's testimony is filled with holes.
Lujan: Isn’t it true that you eventually spoke to the officer?
Terlaje: I do not remember that sir.
Lujan: In fact, you gave the officer the driver's license of Ms. Aguon. Do you remember?
Terlaje: I do remember but because of the situation I was assisting getting the information of the people in the vehicle to the officers.
Throughout the trial, the defense continuously argued that Aguon was not at fault, and not the one behind the wheel that night.
Lujan further pressed Terlaje contending that because she was a police officer, she abused her authority to intervene with the police investigation at the scene.
Terlaje: At the time I was not acting in my official capacity. I just was the more calm person in the situation.
Lujan: Well you were the one that spoke to the officer among the four of you.
Terlaje: I do not remember that.
Lujan: You were the one that also spoke to Officer Champion when he first arrived at the scene. Isn’t that right?
Terlaje: Yes.
Lujan: And you felt comfortable assisting Officer Champion because you were not on duty. You can’t separate the fact that you are a police officer. Isn’t that right?
Terlaje: They needed assistance in getting information so I assisted.
But, Terlaje remained firm on why she was assisting.
Lujan: You were the one calm person. You were so calm that you never thought to tell anyone as to the reason why no one sat in the front until Monday when you testified all the reasons why…You never mentioned it to any other human being is that right?
Terlaje: Correct.
Aguon is on trial in connection with the February 2021 crash that left severe damage to Jerry Kitchen in Tamuning. There's no word yet if she will take the stand.
