Nicholas Moore calls for another mistrial in drive-by shooting case
The murder defendant facing a retrial in connection to a separate drive-by shooting case is back in Superior Court today but defendant Nicholas Moore went before a new judge.
Moore appeared before Judge Vernon Perez.
The case was previously heard before Judge Alberto Tolentino. Defense again called for a mistrial arguing Moore was denied his right to a public trial.
This despite the case being widely publicized in the media.
Defense also called for co-actor Eric Salone to testify once trial gets going.
In October 2020, Moore was accused of allegedly shooting at two men, hitting one, near the Agana Heights basketball court.
It was one year ago a judge declared a mistrial after multiple delays.
Defense had requested Judge Tolentino be recused from overseeing the retrial.
Moore, who is currently out on house arrest, is set to appear back in court on Jan. 31. Meantime, he still awaits his day in court for his murder case.
