Abortion remains legal in Guam, Supreme Court of the United States declines to hear appeal

Abortion services remain legal in Guam. 

This comes after the U.S. Supreme Court denied a petition seeking to overturn the Guam Supreme court’s decision that Guam Public Law 20-134, a 1990 abortion ban, had been repealed by laws the Guam legislature subsequently passed.

Attorney General Doug Moylan filed the petition. 

As KUAM reported, the AG sought to vacate a permanent injunction that has prevented the imposition of a 1990 abortion ban on Guam.

The AG cited the Supreme Court's June 2022 dobbs ruling that overturned Roe v. Wade and argued that there is no longer any basis in law to support the permanent injunction.

The Guam Supreme Court’s decision remains in place. 

In response to SCOTUS declining to hear the appeal, Governor Lou Leon Guerrero stated, “It is time to finally put this issue to rest, and now women can have access to safe and legal abortions."

Jayne Flores, Director of the Bureau of Women’s Affairs, stated, “Si Yu’os Ma’ase to all of the people who have fought to preserve women’s healthcare rights, whether you have been out there or quietly fighting the fight through your vote.”
