Elderly man suing Guam Police Department alleging police brutality

An elderly man has filed a federal lawsuit against the Guam Police Department and an officer identified as K. Diaz.

The man who is suing the police department contends he was driving in Tamuning when the officer pulled him over for speeding in March of last year.

After that man asked to see the officer’s radar to verify how fast he was going, officer Diaz and another unnamed officer allegedly pulled the 63-year-old retiree out of the car causing him to fall to the ground.

The man alleged the officer punched the back of his head and hit his eye, and caused injuries to his back and ribs.

He was taken to the hospital to be treated before police took him to the precinct to be photographed and fingerprinted.

The man also contends $2,000 went missing from his wallet and his phone was cracked after the alleged attack. 

He filed a complaint with GPD’s internal affairs and the complaint was lodged in federal court last week.

The man is seeking $100,000 in damages along with the money that went missing from his wallet.

In response to the complaint, Assistant Attorney General Graham Botha denied that GovGuam is liable for the negligent acts and called for a federal judge to dismiss the complaint.
