Former Health Director and Chief Inspector cleared of criminal charges

A major update to report in a government corruption investigation.

Former Public Health Director Art San Agustin and Chief Health Inspector Masatomo Nadeau are clear of all charges filed against them in a government corruption investigation.

Superior Court Judge John Terlaje dismissed the case with prejudice meaning the pair cannot be tried again on the same allegations.

In Summer 2023, the Guam Attorney General sought an indictment against the duo alleging they signed off on certain school inspection reports for campuses that were apparently never inspected.

The judge dismissed the case with prejudice after the AG's office failed to comply with the court’s order to appoint a special prosecutor.

Defense Attorney Jay Arriola told KUAM, “Art San Agustin is a man of faith and humble character who has been a public servant helping our island’s most vulnerable members of society through his work at Public Health for decades. He was not guilty of any crimes other than the attorney general’s office’s malpractice in this case. It never should have been brought and orchestrated by Doug Moylan for his personal political aggrandizement. The rules of professional conduct apply to him and his office. When you violate the rules, cases are dismissed with prejudice.”

You may recall, the court also dismissed the government corruption case involving the Guam Regional Transit Authority for the same reason.
