Defense for Evan Montvel-Cohen seeks time served in fraud case

A disgraced Guam radio executive convicted in a scam involving more than a million dollars is hoping to get out of prison sooner than expected. 

Evan Montvel-Cohen, who is serving an 82-month sentence, appeared before Chief Judge Frances Tydingco-Gatewood in the District Court of Guam.

Montvel-Cohen won his fight before the U.S. Court of Appeals argued the District Court's decision to run his sentences consecutively instead of concurrently was a “simple mistake.”

Defense is now asking that he be given time served. 

Resentencing was delayed to allow the prosecutor more time to respond to the defense. 

As KUAM reported, Montvel-Cohen pleaded guilty to charges of bank fraud and use of means of identification in furtherance of fraud.

The feds contend in one scheme, he used another man’s identity to rent a home in Tamuning to have an affair but never paid rent.  

The other, he offered a man a job at the advertising firm C2 social in 2019, and sent the man a check to relocate to Guam but the check bounced.
