Ex-airman denied request to dismiss superseding indictment

A former airman is denied his request to have a child molestation case against him dismissed.

Defense for Louis Vargas argued double jeopardy calling for the superseding indictment handed down against him to be tossed.

Presiding Judge Alberto Lamorena ruled double jeopardy does not bar the defendant from being retried.

As reported, prosecutors decided to retry Vargas on the remaining criminal sexual conduct charges that the jury did not reach a verdict on at trial.

Assistant Attorney General Christine Tenorio contends they are required to retry the case arguing it isn’t double jeopardy.
