A mother accused in the death of her 3-year-old boy will get a separate trial before a superior court judge.

Defendant Jonarie Cruz was granted her request to severe the case from co-defendant John Paul Charfauros.

Cruz's defense argued unfair prejudice to have the cases prosecuted together.

Presiding Judge Alberto Lamorena granted her request.

As KUAM reported, the child was brutally beaten and repeatedly forced underwater at an apartment pool in Dededo back in July.

Charfauros allegedly told police he was teaching the boy how to swim.

The toddler died days later at the hospital.
