The lawsuit filed by parents of two students with disabilities, alleging that education officials violated the Adequate Education Act, is moving forward.

This after Superior Court Judge Elyze Iriarte dismissed several other claims added to the case back in September.

Today, parties returned to the courtroom to address multiple motions.

These include the Guam Department of Education's motion for summary judgment and cross-motions by Guam Legal Services Corporation-Disability Law Center representatives seeking declaratory relief and injunction.

Judge Iriarte granted attorneys with GDOE to file another motion and are set to  respond by Jan. 31. That’s next Friday, regarding jurisdictional inclinations around whether the remaining claims meet strict and substantial compliance under the Government Claims Act. 

Representative Attorney Phil Tydingco will then have until Feb. 7 for his response.
