A Department of Corrections captain accused of mishandling contraband and insubordination fought his disciplinary action before the Civil Service Commission this week.

DEPCOR captain Franklin Santos is appealing his five-day suspension without pay.

Last June, officers found four packs of cigarettes and wrappers thrown over the perimeter buffer zone area at the prison.

Investigators testified that Santos took the contraband out of the facility and put it in his vehicle, rather than handing it in as evidence.

Santos contends he followed department policy when he tried to turn in the contraband to Guam Police, but they refused telling him it wasn’t major prison contraband.

Santos and DEPCOR director Fred Bordallo are scheduled to testify during the next hearing set for April 22.
